If my spouse is cheating in my home, can I hire a private investigator to obtain video surveillance inside my house?
I am often asked by new clients that want to catch their spouse cheating on video by a private investigator if it is legal for a private investigator to come into their home to conduct the video surveillance?
The client has a strong suspicion that their cheating spouse is having the extra marital affair inside of their home and wants to get the sexual activity on video as proof for their cheating husband or cheating wife that they are onto their infidelity.

Husbands often ask this question: If I catch my wife cheating will I get custody of my children?
As a private investigator I am not in a position to answer this question from a legal standpoint. What I can tell you as a private investigator catching cheating wives and spouses in NY & CT for some time it has been my experience the mother, despite her extra marital affair proven on video by an expert private investigator retains custody of the children time & time again. This is usually a devastating blow to the broken hearted father’s who remain committed to their families. However, it is typically in the courts opinion 99% of the time, that children are best left with their mothers despite her infidelity and cheating ways. This seems to hold true in New York, Connecticut and beyond, unless the mother is severely abusive towards the children, has substance abuse problems and mental issues that can be proven to the courts.
